Consent To Electronic Communications and Use of Electronic Signatures
This Consent to Electronic Communications and Use of Electronic Signatures (“Consent”) is between you and Community Bank and Trust, a Georgia Bank, including our agents, representatives, or affiliates or anyone acting on our behalf (“Bank,” “we,” or “us”). If you choose not to agree to this Consent or withdraw your consent, you will be restricted from obtaining certain services and products from Bank
You have the right to get notices on paper
Throughout your relationship with us, we will need to exchange communications (“Communications”) with you. Communications are disclosures, notices, agreements, fee schedules, invoices, statements, records, documents, and other information that we, our agents, representatives, affiliates, or anyone acting on our behalf provides to you or that you sign, submit, give, or deliver to us. Under federal law, we are obligated to exchange these Communications with you “in writing” and, if you prefer, on paper.
We prefer to exchange Communications with you electronically. “Electronically” or “Electronic” means the internet, a website, email, messaging services (including text messaging), software applications (including applications for mobile or hand-held devices), satellite, cable, or any other type of virtual communication or transmission method, whatsoever, in existence now or in the future.
To send you Communications Electronically, we must get your consent to do so. Additionally, to get your signature and agreement for documents Electronically (for instance, by digital signature), we must get your consent. We appreciate your agreement to this Consent, which is as follows:
- Consent to Electronic Delivery
Unless otherwise required by law, you agree that we may deliver Communications to you Electronically, and that this Consent applies to all Communications we send to you, or disclose or communicate to you, throughout our relationship with you, including the following: (a) loan or advance documents; (b) any disclosures that are required by law to be in writing, including, without limitation, federal disclosures and tax forms; (c) payment authorizations, electronic payment authorizations, and transaction receipts or confirmations; (d) account statements and history; (e) this Consent; (f) a Privacy Notice (“Privacy Policy,” provided separately); and (g) any other notices, statements, or communications about your relationship or transactions with us whatsoever.
You specifically consent to receive and access Communications Electronically by email using the email addresses we have on file for you and by text message to the phone numbers or other location numbers we have on file for you.
You agree that any such Electronic Communication will be reasonable and proper notice for the purpose of any and all applicable laws, rules, and regulations, and you agree that such Electronic form fully satisfies any requirement that such communications be provided to you in writing or in a form that you may keep.
When you Electronically sign a document, it will be stored in an archive that you can access online. You may also access and review Electronic copies of all Electronic Communications in this archive or on our website. If you have problems accessing Electronic copies of Electronic Communications, please contact us immediately using the Contact Points (listed below).
Your consent does not mean we must provide Communications Electronically—only that we may do so. We may, at our option, deliver Communications on paper. We may also require that certain Communications from you be delivered to us or our third-party service providers on paper at a specified address.
- Authoritative Copies
You agree that the authoritative copy of the Electronically signed Communications (the “Authoritative Copy”) will be an electronic copy that resides in Bank’s document management system or that of its agents, servicers, and service providers. If a paper version of the Authoritative Copy is created, then both the electronic version and paper version shall be considered originals and shall both be an Authoritative Copy.
- Consent To Electronic Signature
You agree that we may use Electronic signatures and obtain Electronic signatures from you in any Communications.
- Consent Scope and Coverage
Your consent covers all Communications with us and remains in effect until you give us notice that you are withdrawing it.
- Withdrawal of Consent to Electronic Communications
You may withdraw your consent to receive Electronic Communications at any time, but the withdrawal of your consent to receive Electronic Communications may result in the termination of your access to our Electronic services. Any withdrawal of your consent will be effective after a reasonable period of time for processing your request, and we will confirm your withdrawal of consent and its effective date in writing (either electronically or in paper form).
